Terms of Service — Head North

By installing or using Head North ("the App"), you agree to these Terms.

1. What the App Is (and Is Not)

Head North is a GPX track viewer.

It allows you to:

• load GPX files
• view tracks on a map
• see your live position and heading
• keep the map visible using Picture-in-Picture

The App:

• does not provide turn-by-turn navigation
• does not perform routing or re-routing
• does not guarantee accuracy, safety, or trail conditions

2. License to Use

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial GPX viewing.

You may not:

• reverse engineer or modify the App
• use the App for commercial navigation services
• copy or redistribute the App or its components

3. Use at Your Own Risk

The App is provided for reference only.

You are responsible for:

• your safety
• complying with traffic, riding, and distracted-use laws
• maintaining awareness of your surroundings

The App may fail due to:

• GPS drift
• sensor inaccuracies
• outdated GPX files
• map data errors
• device or OS limitations

Do not rely on the App for emergency or high-risk navigation.

4. Acceptable Use

You agree not to:

• use the App in a way that distracts from safe operation of a vehicle
• bypass Android safety restrictions
• misuse Picture-in-Picture while riding unlawfully

We may suspend access for misuse.

5. Purchases & Refunds

• The App is a one-time purchase
• No subscriptions
• All payments and refunds are handled by Google Play

Refund eligibility follows Google Play policies.

6. No Warranty

The App is provided "as is" and "as available".

We make no guarantees regarding:

• uptime
• accuracy
• suitability for any purpose

7. Limitation of Liability

To the maximum extent permitted by law, Odd Horizon OÜ is not liable for:

• accidents, injuries, or damages
• navigation errors
• loss of data
• indirect or consequential damages

8. Indemnification

You agree to indemnify and hold harmless Odd Horizon OÜ from claims arising from:

• misuse of the App
• violation of laws
• unsafe reliance on the App

9. Termination

We may suspend or discontinue the App at any time.

No liability arises from:

• feature removal
• App discontinuation
• access suspension

10. Intellectual Property

The App and its code are owned by Odd Horizon OÜ.

Maps are provided by:

• Mapbox
• OpenStreetMap contributors

11. Governing Law & Venue

These Terms are governed by the laws of Estonia.

EU consumer protections remain unaffected where applicable.

12. Changes

Material changes will be communicated via:

• App updates
• public posting in the App listing

Continued use means acceptance.
